TERMS AND CONDITIONS FOR SERVICE WITH COMMUNITEL
Except as stated below, this statement applies to all residential customers who obtain pre-paid service from Communitel on a monthly basis.
This statement does not apply to the rental of any telephone equipment or attachments or any part of the telephone equipment past the demarcation (“Demarc”) location at the phone service box located outside the residence.
In this agreement, the words “I”, “my” or “me” refer to the subscriber renting the telephone services from Communitel . “Telephone Service” means local phone service subscription only and excludes the actual telephone set, equipment, attachments or wiring within the premises of the subscriber.
TERMS AND CONDITIONS:
1. Telephone Service : Communitel agrees to give subscribers the right to use and enjoy the telephone service for the term mentioned in paragraph 2 of the agreement.
2. Term : Effective on the date telephone service is activated and operating according to Communitel . The term will automatically be extended for 1month upon Communitel's receipt of successive payment made by the assigned due date. The assigned due date shall be the date of original activation for each successive month.
3. Use of Service : The telephone service is to be used in a careful and lawful manner and subscribers may not damage, misuse, tamper with or otherwise improperly deal with the service. Subscribers assume to bear the entire risk of loss, damage or destruction of the telephone service for any cause, except for normal wear and tear.
4. Maintenance and Repair of Telephone Service : All maintenance or repairs necessary between the Telephone set to the Demarc location shall be the subscriber's responsibility. Communitel agrees to supply telephone service to the Demarc location and has the responsibility of any maintenance or repairs up to the Demarc location only. In the event that a repair request is made by a subscriber, and it is deemed that the repair was caused by subscriber equipment or attachments or any other causes within the premises, then the subscriber will be responsible for any of the costs for such repairs. Communitel reserves the right to request a security deposit prior to the commencement of any repairs or prior to testing any faults in the telephone service. Such deposit will be returned to the subscriber within 30 days after the repair is completed and deemed not the result of subscriber equipment, wiring or damage.
5. Monthly Service Fees : Subscribers are to pay the monthly service charge prior to or by the specified due date. If Communitel is not in receipt of payments by the specified due date, Communitel may disconnect the services without further warning to the subscriber.
6. Late Fees : Communitel charges a late charge of $20.00 in the event Communitel does not receive monthly service fees, in full, by the prescribed due date. Failure to pay this late charge may result in service being disconnected.
7. Restrictions on Service : Telephone service is for local calling only. Subscribers are not to attempt to or incur additional charges onto their service through such uses as Long-distance calls, Collect calls, Directory Assistance charges or cause any other charges onto the phone service through any other phone company. Should any charges occur onto the phone services, these amounts will become due upon demand from Communitel , and failure to pay such amounts when due may result in immediate disconnection of the service.
8. Minimum Contract Period and Cancellation before Service Commencement : The minimum contract period is one month commencing from the date the service is provided.
9. Refunds : Communitel does not refund any prepaid amounts. Refunds for connections are provided only in the event that the connection requires “Fielded Service” and that the subscriber advises Communitel that they do not want to pay this additional cost. If Fielded service is required, subscribers must pay for such work prior to Communitel scheduling the field work.
10. Telephone Jacks and Inside Wiring : The subscriber is responsible for the installment, or repairs to any inside wires or jacks.
11. Warranties : Communitel represents that subscribers have selected the service under the terms of this statement. Communitel has made and makes no representation or warranties of any kind or nature, directly or indirectly, expressed or implied as to any matter whatsoever, including the suitability of service, its durability, its condition or its quality. Communitel shall not be liable to subscribers or any others for any loss, damage or expense of any kind or nature caused directly or indirectly by any service however arising or the use or maintenance of the service or the failure of operation of the service, or the repairs, service or adjustments to the service. Regardless of the cause, subscribers are not to assert any claim whatsoever against Communitel for loss or anticipatory profits or any other indirect, special or consequential damages.
